These Terms and Conditions (“Terms”) govern access to and use of Apex Olira, including all related websites, applications, software, creative tools, cloud services, and features.
By accessing or using Apex Olira, you agree to be bound by these Terms.
1. ELIGIBILITY
You must be legally capable of entering binding agreements and meet the minimum legal age in your jurisdiction. If using Apex Olira on behalf of an organization, you represent that you have authority to bind that organization.
2. USER ACCOUNTS
You agree to provide accurate information and maintain account security. Apex Olira reserves the right to suspend or terminate accounts violating these Terms.
3. ACCEPTABLE USE
Users agree not to:
- Violate laws or infringe intellectual property
- Upload malicious code or disrupt services
- Harass others or engage in fraudulent activity
- Reverse engineer or circumvent security systems
4. USER CONTENT
Users retain ownership of original content. By uploading, you grant Apex Olira a non-exclusive license to host, store, and process content solely for operating the service.
5. INTELLECTUAL PROPERTY
All Apex Olira branding, software, designs, and platform components remain the property of Apex Olira or its licensors.
6. AI FEATURES & GENERATED CONTENT
Users acknowledge that:
- AI outputs may contain inaccuracies
- Similar outputs may be generated for different users
- Users remain responsible for reviewing generated content
7. PURCHASES & PAYMENTS
Certain brush packs and palettes require payment. Each is a one-time purchase, priced individually and charged once at the time of purchase — there is no subscription and no recurring charge. Prices may change with notice; taxes may apply. A price change never affects a pack you have already bought. See the Cancellation and Refunds page for the full refund policy.
8. FREE PACKS
Free brush packs and palettes are not a time-limited trial. They do not expire, do not require payment, and are not converted into a paid purchase automatically or otherwise.
9. SOFTWARE UPDATES
Apex Olira may deploy feature updates, security patches, and bug fixes. Certain updates may be automatic.
10. SERVICE AVAILABILITY
We do not guarantee uninterrupted operation. Services may be modified or discontinued at any time without liability.
11. THIRD-PARTY SERVICES
We are not responsible for third-party availability, external content, or data handling outside Apex Olira systems.
12. TERMINATION
We reserve the right to suspend access for violations of these Terms or prohibited conduct.
13. DISCLAIMER OF WARRANTIES
Apex Olira is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties including merchantability and accuracy.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Apex Olira shall not be liable for indirect damages, lost profits, or data loss.
15. INDEMNIFICATION
Users agree to indemnify Apex Olira from claims arising from user content or violations of these Terms.
16. GOVERNING LAW
These Terms shall be governed by applicable laws of the jurisdiction selected by Apex Olira.
17. DISPUTE RESOLUTION
Users agree to attempt good-faith informal negotiation before initiating formal proceedings.
18. FORCE MAJEURE
Apex Olira is not liable for failures caused by natural disasters, cyberattacks, or infrastructure failures beyond control.
19. SEVERABILITY
If any provision is found unenforceable, remaining provisions shall continue in effect.
20. ENTIRE AGREEMENT
These Terms constitute the complete agreement regarding use of the Platform.
21. CHANGES TO TERMS
Continued use after updates constitutes acceptance of revised Terms.
